Jere Bagenstose in back in the Lancaster County Prison following the Pennsylvania Supreme Court’s ruling in Commonwealth v. Yard, the DA explained.
Bagenstose has charged with criminal homicide in Dec. 2022 or the 1984 murder of his wife, Maryann Bagenstose, as Daily Voice previously reported.
Bagenstose was released after posting a bail for $925,000 as set in May 2023, after "the Pennsylvania Supreme Court’s decision in Commonwealth v. Talley, which required the trial judge to hold a hearing to determine whether bail should be set in the Bagenstose case," the DA explained. "In Yard, the Supreme Court held that the Talley case dose not apply to homicide cases in which a defendant could be sentenced to life imprisonment without parole." Since then, the Commonwealth filed a motion to revoke bail as a result of that decision.
The motion was granted by Senior Judge John Kuhn, who ordered Bagenstose to report to Lancaster County Prison by Monday, Oct. 7.
Assistant District Attorneys Mark Fetterman and Jessica Collo filed the motion and are prosecuting the case.
The case is currently scheduled for trial in March 2025.
